With more than 25 years’ experience acting for professional indemnity (PI) and liability insurers, Hugh has both ‘hands on’ expertise in conducting litigation plus in-depth knowledge of insurance law. During his career, he has regularly advised on policy construction, provided expert claims management with a focus on settlement, and conducted litigation through to trial and on to appeal.

This blend of extensive experience and excellent understanding of the needs of insurers allows Hugh to swiftly and comprehensively respond to insurance sector clients seeking advice on policy response, liability (both common law and statutory) and early resolution through mediation.

In the professional indemnity area, Hugh has acted in connection with disciplinary proceedings involving – as well as claims against – lawyers, architects, engineers, real estate agents and accountants. More recently, he has handled similar matters involving financial planners and mortgage brokers in matters concerning breaches of the National Credit Act as well as the Australian Consumer Law. He has been commended for his ability to work with insured parties and their brokers in circumstances where the deductible is sizeable.

In addition, Hugh frequently acts for major Australian insurers operating in the areas of property, liability, engineering and construction / building. This experience spans claims under property, construction all risks, contractor all risks, industrial special risks and business interruption policies. Most recently, his work has included numerous property claims initiated under the Building Services (Complaint Resolution & Administration) Act 2011 (WA). He is also regularly instructed to act in personal injury and employment practices liability matters from liability insurers, including many multi-jurisdictional disputes.

Hugh has a comprehensive understanding of the proportionate liability regimes set up under the Competition & Consumer Act 2010 (Cth) and the Western Australia’s Civil Liability Act 2002. He also has significant experience as counsel and regularly appears in the WA District Court, Supreme Court and the State Administrative Tribunal.
