Rosemary joined Moray & Agnew in March 2012. She was previously a partner of Sparke Helmore.
Rosemary has extensive commonwealth compensation, public liability and industrial disease claims (including workers compensation claims arising from asbestos / dust / toxic chemical exposure).
Rosemary has managed numerous national test cases in the area of Commonwealth compensation which have included matters before the Administrative Appeals Tribunal (‘the AAT’) and the Federal Court of Australia (for example: Comcare v Hill and Etheridge in which her client was successful before both the AAT and the Full Federal Court. This is a significant test case determining the respective liabilities of the Commonwealth and other parties for compensation for disease arising from asbestos exposure).
Rosemary has recently managed numerous matters that have proceeded to hearing before the Administrative Appeals Tribunal (AAT) including the matter of Lamont re Telstra Corporation Limited in which her client was successful.
She has also continued to provide strategic claims advice with an emphasis on achieving early resolution of disputes. In this context Rosemary is a very experienced negotiator who regularly represents clients in mediations in the Supreme Court of Western Australia and conciliations in the AAT. She has undertaken formal mediation training and has been accredited as a mediator. She has also trained other lawyers and clients in mediation and negotiation skills.
